Chickie's & Pete's skimming tips?

Chickie's & Pete's owner Pete Ciarrocchi may find himself in court soon, but it won't be for someone trying to rip off his trademarked Crab Fries(R). The Daily News is reporting a former bartender at one of Chickie's airport outlets is suing the company for allegedly skimming tips via a "Pete Tax" paid out of servers' credit-card gratuities each night. It's uncertain whether this levy is used to assuage C&P's no doubt astronomical credit-card transaction fees, but thanks to Councilman Jim Kenney's Gratuity Protection Bill, that's considering stealing these days. Looks like Marc Vetri and Stephen Starr should make room at the griping table for one more.
